Defective Products Liability
Manufacturers have a duty to design and manufacture products that are safe for consumers to use. They must also alert consumers of any potential problems related to their product. Yet, every year, thousands of consumers sustain serious injuries from products that are faulty in design, manufacture, usability or lack of proper instructions and/or warnings.
If you have been injured by a defective product, you may be entitled to compensation. For example, we represented 21 nurses in latex glove litigation in 17 states; and each and every case resulted in our client obtaining compensation. As another example, we represent a number of mine workers who have been harmed by inhaling silica. Cases have been filed against the manufacturers of the respirators our clients used believing they were protecting themselves by using these respirators, only to discover they were defective products.
Examples of defective product include a vast range of situations, from dangerous toys to appliances to machinery, to sports and recreational equipment, and can include defects that lead to car accidents, truck accidents or airplane accidents as well as defective medical devices, such as the Ancure Aortic Graft, defective shoulder pain pump and dangerous drugs.
Defective products are sometimes recalled or discontinued by the manufacturer, but that is not always the case.
With some exceptions, most product liability lawsuits must be filed with two years of the date of injury, so if you think you might have a product liability case, it should be investigated as soon as possible.
