What is the Problem?

Phillips has issued a recall of some of their CPAP and BiPAP machines because users of the CPAP machines may have been breathing a toxic substance that can cause cancer and lead to other serious health problems.

Phillips CPAP and BiPAP are machines that push a stream of pressurized air through an air filter and into a flexible tube.  From the flexible tube air is pushed into a sealable mask assisting users in breathing correctly while they slept.

To abate the sound of the machine, Phillips used a polyurethan foam to make the machine run quieter. Over time the foam may break down, especially where people use ozone cleaning methods or where the foam is exposed to high heat and humidity. Once the foam breaks down, the foam debris or certain chemicals released into the device’s air pathway may be inhaled or swallowed by the person using the device.

What do Phillips CPAP Lawsuit Allege?

Phillips CPAP Lawsuits are based on the sound legal doctrines of:

Design Defect

In simple terms the CPAP machines were sold in a defective and unsafe condition for its intended use. The fact that the foam Phillips used degrades and causes cancer is substantial evidence for a lawsuit.

Failure to Warn

The failure to warn claim against Phillips is one interesting allegation. There are allegations that users complained for years of health problems associated with the CPAP machines, but nothing was done.  If through the discovery process plaintiffs can find internal document or other evidence that Phillips knew for months or years before the June 2021 recall, then the failure to warn claim will have a substantial effect on the outcome of Phillips CPAP lawsuits.
